Although a spouse`s support obligation ends with a court order or agreement that is silent or does not provide for support (section 15001.3), curiously, this does not apply to children. According to section 15001.4, an executive order that is silent on the issue of child support does not affect a Marine`s obligation to assist children under the Manual. The guide sets out monthly support standards that members must follow in the absence of a court agreement or order. Under Article 15004, the amount payable at the request of a family member is expressed as a fraction of the basic housing allowance (BAH) or overseas housing allowance (OHA) received by the Navy, with a minimum amount per family member: Complaints should be addressed to the Commander of the Navy, who will then advise and encourage the navy to consult with legal counsel. Echoing the Navy, the Marine Corps bluntly states its policy: “The Marine Corps will not serve as a refuge for personnel who do not provide adequate and ongoing support to their family members. MCO P5800.16A, Marine Corps Manual for Legal Administration, Chapter 15, Section 15001. Under Section 15002, a Marine is subject to penalties for failure to comply with a judicial support order or the above provisions. The member`s commanding officer (colonel or above) under section 15005 may reduce or eliminate the requirement for assistance in the following circumstances: There is no maintenance obligation between spouses without children on active duty. Support is provided in cash, cheque, money order, stipend, etc. Benefits in kind are not provided. “This chapter is punitive and violations of this order are punishable under the UCMJ and may expose the offender to adverse administrative action.” Chapter 15000. In no event may a Marine be required to pay more than 1/3 of his gross military salary, which includes base salary and all allowances.
